Two years for indecent assault

A 35-year old man from Gouyave, St. John’s has been sentenced to two years in jail for indecent assault.

Albert Richards who pleaded guilty to the sexual offense of a minor at the start of the January Criminal Assizes, was sentenced on Monday by High Court Judge, Justice Lyle St. Paul at High Court Number Two.

Crown Counsel Howard Pinnock who presented the facts to the court said that on May 13, 2011, the convicted man launched his attack on the minor on the compound of the school which the child attends.

Richards was caught in the act of pulling down the 7-year old child’s underwear and placing his mouth in the area of her private part by a resident of the area.

Defense Counsel Ashley Bernardine who mitigated on behalf of Richards told the court that the convicted man has been in and out of the Mt. Gay Mental Hospital 16 times. In addition to the prison sentence, Justice St. Paul ordered that Richards be given a psychiatric evaluation.

The maximum penalty for indecent assault is five years imprisonment. Richards is among 21 persons who are facing charges of sexual offenses in the current assizes.

Some of the other sex-related offences include rape, indecent assault, unlawful carnal knowledge, unnatural carnal knowledge, and unnatural connection.
