No bail for Stanisclaus and John

Poultry Farmer Alister Stanisclaus and his employee, Andy John remain confined at the Richmond Hill Prison awaiting trial for a number of offenses including possession of a firearm and ammunition, robbery, and harbouring a criminal.

 Stanisclaus and John who reside at Mt. Parnassus, St. George’s were charged by the police three months ago with possession of a firearm and ammunition that were found inside of the driver’s door compartment of a Green Escudo van, registration number PN812 which crashed on the Beausejour main road in St. George’s with a police vehicle on July 27.

 Both accused men are also accused of abetting and facilitating St. Patrick’s resident, Seon Grant from evading the lawmen.

 They are also jointly charged with Grant’s girlfriend, Mindy Francis from River Sallee, St. Patrick’s for harbouring a fugitive.

 One month later, police brought a charge of robbery on Stanisclaus and John.

 They are accused of robbing C-Tech Gas Station in Grand Anse, St. George’s in early July an estimated $29,000.00.

 However, since their arrest three months ago, the court is not able to hear any of the evidence relating to the charges.

 They were brought to court on Monday, but the Police Prosecution Department informed Magistrate Karen Noel that they are still awaiting results from the gun that was sent to Barbados for ballistic testing.

 Attorney-at-law, Derek Sylvester who is counsel for Stanisclaus and John, Derick Sylvester made an application for bail for the remand prisoners.

 Sylvester based his arguments on the length of time the accused men are on remand awaiting trial, the over-crowdedness of the prison and the conditions that exist there.

 The city lawyer indicated that at every instance since the men’s arrest, the delay in the commencement of the Preliminary Inquiry was due to the inability of the Prosecution, and administrative hurdles.

 He spoke of the conditions under which the 435 prison inmates have to live as being human indignity.

 Sylvester said it would not be proper to say keep the men in prison until the State is ready to proceed with the cases.

 However, the Police Prosecution Department said it will continue to maintain the reasons given for objection to bail ass advanced by Director of Public Prosecution, Christopher Nelson when the matter came to court for the first time.

 The Prosecution is maintaining that the alleged offenses are very serious, and that the police are still investigating other matters involving the two suspects.

 After listening to the arguments of both sides, the bail application was denied by Magistrate Noel.

 Stanisclaus and John are due back in court on November 15.

John has a number of matters pending at the High Court including housebreaking, stealing, damage to property, attempted robbery with violence, and possession of ammunition.

 He is also accused of causing material damages in January 2009 to Republic Bank that was previously located on Wall Street in Grand Anse.

 At the time of his arrested and charge by the police in July, John was on bail for the Republic Bank matters.
